These Terms of Service govern your use of wittyharbor.com and any purchase you make from us. By browsing or ordering, you agree to them. Please read them before you buy.

1. Who we are

This website is operated by Witty Harbor. Throughout the site, “we”, “us” and “our” refer to Witty Harbor; “you” refers to you, the visitor or customer.

2. Using the store

You confirm that you are at least the age of majority where you live, or that you have the consent of a parent or guardian. You agree not to use our products or website for any unlawful purpose, and not to breach any law in your jurisdiction. Breaking these terms ends your right to use the service immediately.

3. Products, colours and availability

All items are printed to order and quantities of certain designs may be limited. We have made every effort to display product colours accurately, but we cannot guarantee that your screen shows a colour exactly as it prints. Slight variation in placement, tone and garment shade is inherent to print-on-demand production and is not a defect.

4. Pricing and changes

Prices are in US Dollars and may change without notice. We may modify or discontinue any product at any time. We are not liable to you or to any third party for a price change, modification, suspension or discontinuation.

5. Order acceptance

Your order is an offer to buy. We may refuse or cancel any order, including where the item is unavailable, where there is an obvious pricing or description error, or where our fraud screening flags the transaction. If we cancel a paid order, we refund it in full.

6. Accuracy of your information

You agree to provide a current, complete and accurate shipping and billing address, and to keep it updated. Orders that cannot be delivered because of an inaccurate address are covered by our Shipping Policy.

7. Personalised items

When you submit custom text, a name or a date, you are responsible for its spelling and accuracy, and you confirm that you have the right to use it. We reserve the right to refuse any personalisation that is offensive, infringing, or unlawful. Personalised items cannot be cancelled once production has begun.

8. Intellectual property

All designs, artwork, text, logos, photographs and layouts on this site are owned by Witty Harbor or used under licence, and are protected by copyright and trademark law. You may not reproduce, resell or redistribute them without our written permission. See our DMCA & Copyright page.

9. Third-party links and tools

Our site may link to third-party websites or embed third-party tools. We do not control them, are not responsible for their content or accuracy, and provide access to them “as is”. Any dealings with a third party are between you and them.

10. Comments and submissions

If you send us ideas, reviews, suggestions or other material, you agree we may use, edit and publish it without restriction, without compensation, and without any obligation of confidentiality. You are responsible for anything you submit and agree not to post anything unlawful, abusive or infringing.

11. Prohibited uses

You may not use the site to break any law, to harass or abuse others, to upload viruses or malicious code, to scrape or harvest data, to interfere with the security of the site, or to impersonate anyone.

12. Disclaimer of warranties

15. Severability and entire agreement

If any provision of these terms is found unenforceable, the remaining provisions stay in force. These terms, together with the policies linked from our footer, form the entire agreement between us and supersede any prior understanding.

16. Errors and omissions

Occasionally information on the site may contain a typographical error or inaccuracy relating to a description, price or availability. We reserve the right to correct such errors and to cancel affected orders, even after the order has been submitted.
